Terms of Service

1. Acceptance of Terms & Governance
By accessing or interacting with the BKG Platform, its smart contracts, or holding the BKG digital asset (collectively, the "Platform"), you unequivocally agree to be bound by these Terms of Service. If you do not agree to these terms in their entirety, you are strictly prohibited from using the Platform.
2. Eligibility & Restricted Jurisdictions
You must be of legal age (at least 18 years old or legal majority in your territory) and fully authorized under the laws of your residence to engage with blockchain-native hard commodity assets. BKG strictly restricts usage to residents or citizens of sanctioned territories (including OFAC and EU sanctions lists).
3. Nature of BKG & Gold Backing Claims
BKG represents an immutable, fractional claim on physical, vaulted gold bullion certified by independent third-party assayers (Bureau Veritas and SGS Group). BKG does not confer equity ownership in the underlying mining entities. All redemptions into physical bullion are subject to institutional minimum lot sizes, vault logistics, and strict AML/KYC verification.
4. Smart Contract Risks & Protocol Updates
While smart contracts have been formally verified by CertiK with zero critical vulnerabilities, blockchain protocols inherently carry technological risks. BKG maintains multi-signature governance to execute protocol upgrades, proof-of-reserve oracle synchronizations, and security mitigations.
5. Limitation of Liability
To the maximum extent permitted under applicable law, Bober Khan Wealth Holdings Pte. Ltd., BKW Tech Pte Ltd, PSV Nevada Mining Corp., their directors, and affiliated technology licensors shall not be liable for any indirect, incidental, punitive, or consequential damages arising from blockchain network latency, gas volatility, or unauthorized private key compromise.
6. Governing Law & Corporate Entity
These Terms shall be governed by and construed in accordance with the substantive laws of Singapore and the State of Delaware (USA) regarding US concession operations and commercial agreements.
The Platform is operated by BOBER KHAN WEALTH HOLDINGS PTE. LTD. (UEN: 202430326M), an Exempt Private Company incorporated under the Accounting and Corporate Regulatory Authority (ACRA) of Singapore, having its registered office at Thong Chai Building, 50 Chin Swee Road #09-004, Singapore 169874.
